1. Acceptance of these Terms
These Terms & Conditions (“Terms”) govern your access to and use of californiaplans.org and any related pages, forms, tools, content and services that link to these Terms (collectively, the “Site”). The Site is operated by California Plans, doing business as California Plans (“California Plans,” “we,” “us” or “our”).
By accessing or using the Site, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Site. If you use the Site on behalf of another person, you represent that you are legally authorized to do so.
2. Who we are
California Plans is a California-licensed insurance agency. Our licensed agents may provide information about and assistance with individual and family health insurance, Covered California, Medicare Advantage, Medicare Supplement and Medicare Part D products, depending on agent licensing, certification, carrier appointment, product availability and service area.

This website is owned and maintained by California Plans, which is solely responsible for its content. This Site is not maintained by or affiliated with Covered California, and Covered California bears no responsibility for its content. The email addresses and telephone numbers that appear throughout this Site belong to California Plans and cannot be used to contact Covered California.

California Plans is not connected with or endorsed by the United States government or the federal Medicare program. You can contact Medicare directly at 1-800-MEDICARE (1-800-633-4227) or visit Medicare.gov.

We do not offer every plan available in your area. Currently we represent 14 organizations which offer 125 products in California. Plan availability varies by county and ZIP code. Please contact Medicare.gov or 1-800-MEDICARE to get information on all of your options.
3. Information and services offered
The Site may allow you to:
learn about health coverage options;
request information, a quote or an appointment;
ask to be contacted by a licensed insurance agent;
compare certain plans represented by California Plans;
receive assistance with an eligibility or enrollment application; and
access links to government, carrier or plan websites.
Site content is for general informational purposes. It is not medical, legal, tax or financial advice. Eligibility for financial assistance, a special enrollment period, Medicare or Medi-Cal is determined by the applicable government agency or program, not by California Plans.
4. Plan availability and accuracy
Plan availability, premiums, benefits, provider networks, formularies, cost sharing, service areas, eligibility rules and enrollment periods may change. Information on the Site may be summarized and may not include every limitation, exclusion or condition.
Official plan documents—including the Evidence of Coverage, Summary of Benefits, formulary, provider directory, enrollment materials and insurance policy or contract—control if they conflict with a summary on the Site. You are responsible for confirming that your providers, facilities and prescriptions are covered before enrolling or receiving care.
We strive to provide accurate and current information, but we do not warrant that all Site content is complete, error-free or current. We may correct or update content at any time.
5. No guarantee of coverage, subsidy or savings
Submitting information, requesting a quote, speaking with an agent or completing forms on the Site does not guarantee eligibility, enrollment, issuance of coverage, a premium tax credit, cost-sharing reduction, subsidy, benefit, provider participation or savings.
Coverage is not effective until the applicable marketplace, government program or insurance carrier accepts the enrollment and confirms an effective date, and any required premium is paid. Do not cancel existing coverage until new coverage has been confirmed.
6. Agent authorization and enrollment
California Plans will act as your agent of record only when you provide the authorization required by applicable law and program rules. You may be asked to authorize a licensed agent to access personal information and assist with eligibility and enrollment.
For Covered California applications, any authorization and acknowledgement required by Covered California must be presented before personal information is entered and again before an application is submitted, where applicable. You may decline and instead apply directly through Covered California.
For Medicare products, an agent may discuss only the product types you have agreed to discuss and must follow applicable scope-of-appointment and enrollment rules. You are not obligated to enroll, and your current or future Medicare benefits will not be affected merely because you request information or decline to enroll.
You agree that information you provide will be accurate and complete. You must review all application information before submission and promptly report changes or errors
7. Compensation and carrier relationships
California Plans and its agents may be appointed by and receive commissions or other compensation from insurance carriers or plan sponsors when consumers enroll in or remain enrolled in certain products. Compensation may vary as permitted by law and program rules. You do not pay an additional fee to California Plans for enrollment assistance unless a separate written agreement expressly states otherwise.
California Plans does not represent every carrier or plan available in every area. We do not claim that any plan is best for every person. Recommendations, when provided, should be based on the information you provide and the products the agent is licensed, certified and authorized to offer.
8. Communications, electronic signatures and call recording
If you separately consent, California Plans may contact you by telephone, text message or email about your request or insurance products. Marketing consent is not a condition of purchasing insurance. You may revoke marketing consent through the methods stated in the message or by contacting us. Message and data rates may apply.
Medicare marketing, sales and enrollment calls—including the audio portion of calls made through web-based technology—may be recorded and retained as required by CMS. Where consent to record is required, we will notify you and obtain it before recording. If you do not wish to be recorded, you may ask whether another permitted communication method is available.
Electronic signatures, acknowledgements and records may have the same legal effect as paper documents where permitted by law. You are responsible for keeping your contact information current and for retaining copies of documents provided to you.
9. Your permitted use of the Site
You may use the Site only for lawful, personal and non-commercial purposes related to evaluating or obtaining insurance information or assistance. You may not:
provide false information or impersonate another person;
access or attempt to access another person’s information without authority;
interfere with Site security, availability or operation;
introduce malware or use automated tools to scrape or overload the Site;
copy, modify, distribute or commercially exploit Site content without permission;
use the Site to violate privacy, intellectual property, insurance, marketing or other laws; or
submit Social Security numbers, Medicare numbers, financial account information or medical records through a general contact form unless that form expressly requests the information and uses an approved secure process.
We may restrict or terminate access when reasonably necessary to protect consumers, the Site, California Plans or third parties, or to comply with law.
10. Intellectual property
Except for third-party names, logos and materials, the Site and its content are owned by or licensed to California Plans and are protected by intellectual property laws. No license is granted except the limited right to use the Site under these Terms.
Covered California and Medicare names, marks and materials belong to their respective owners and may be used only as authorized. Their appearance does not imply endorsement of California Plans.
11. Third-party sites and services
The Site may link to Covered California, Medicare, insurance carriers, plan sponsors and other third parties. California Plans does not control those sites, their availability, content, security or privacy practices. Links are provided for convenience and do not constitute an endorsement unless expressly stated. Your use of a third-party service is governed by that party’s terms and privacy notice.
12. Disclaimer of warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SITE IS PROVIDED “AS IS” AND “AS AVAILABLE.” CALIFORNIA PLANS DISCLAIMS IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE.
Nothing in these Terms limits any warranty or consumer right that cannot lawfully be excluded.
13. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CALIFORNIA PLANS AND ITS OWNERS, EMPLOYEES, AGENTS AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM USE OF OR INABILITY TO USE THE SITE.
This limitation does not apply to liability that cannot lawfully be limited, or to duties California Plans owes under applicable insurance, privacy or consumer-protection law.
14. Indemnification
To the extent permitted by law, you agree to indemnify California Plans from claims arising from your unlawful misuse of the Site, your material breach of these Terms or information you submit without authority. This section does not require a consumer to indemnify California Plans for California Plans’ own violation of law, negligence or misconduct.
15. Changes to the Site or Terms
We may change the Site or these Terms to reflect legal, operational or service changes. The “Last updated” date shows when the Terms were revised. Material changes will be communicated as required by law. Continued use after the effective date of revised Terms constitutes acceptance to the extent permitted by law.
16. Governing law and venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles. Unless applicable law requires otherwise, claims relating to the Site will be brought in a state or federal court with jurisdiction over the state of California.
17. Severability and no waiver
If any provision is held unenforceable, it will be limited to the minimum extent necessary and the remaining provisions will remain in effect. A failure to enforce a provision is not a waiver.
